  2. You are responsible for the safekeeping of your password and preventing others from using your account.
  3. You are responsible for any uses of our Site that occur under your account.
  4. You must not abuse, harass, threaten, impersonate or intimidate other Buyfolio users.
  5. You are solely responsible for your conduct and any links or that you submit, post, and display on this service.
  6. You must not send unwanted email to any Buyfolio members or users.
  7. You must be 13 years or older to use this site.
  8. You may not use this service for any illegal or unauthorized purpose.
  9. You must not transmit any worms or viruses or anything otherwise resembling such, whether or not destructive in nature.
  10. You may not use this Site to make false, fraudulent or speculative offers or claims.
  11. You must not, in the use of Buyfolio, violate any laws in your jurisdiction (including but not limited to copyright laws).
  12. You may not access in a manual or automated process Buyfolio content for a reason other than your personal use or for inclusion of Buyfolio pages in a search index.
  13. You may not use any device, software or routine that interferes or attempts to interfere with the normal operation of this web site or take any action that imposes an unreasonable load on our equipment.

Violation of any of these agreements will result in the termination of your Buyfolio account and access to the buyfolio.com web site.

General Conditions

  • We reserve the right to modify or terminate the Buyfolio service for any reason, without notice at any time.
  • We reserve the right, in our sole discretion, to restrict, suspend or terminate your access to all or any part of the Site at any time, for any or no reason, without prior notice or liability. We may change, suspend or discontinue all or any aspect of the Site at any time, including the availability of any feature, database, or content, without prior notice or liability.
  • We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via a message to your account or via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.

  • YOU AND BUYFOLIO AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE BUYFOLIO WEB SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Third Party Content, Sites, and Services

  • The Site may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of Buyfolio, including web sites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole.
  • Your interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.
  • You agree that Buyfolio shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Buyfolio is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Buyfolio, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service.

Returns, Cancellations, Refunds, and Delivery Policy

  • Buyfolio will deliver all services and products in a timely fashion. Web site services and subscriptions will be delivered or activated within 24 hours after successful billing of your account.
  • If you are not satisfied with your Buyfolio purchase please contact us via our online help site.
  • If we are unable to rectify any issues you have with our services within 14 days of the initial purchase we will refund the full amount of the initial purchase.
  • Buyfolio subscription services can be cancelled at any time by emailing support AT buyfolio.com. If the subscription is billed on a recurring basis, and you cancel it during a billing cycle, you will be billed the full amount of that billing cycle.
  • If Buyfolio is unable to bill the credit card on file, notice will be sent to the email address on file and an additional billing attempt will be made at 3-days and 6-days from the first unsuccessful billing attempt. After the third unsuccessful billing attempt, the account will be cancelled.
  • Upon cancellation or repeated payment failure resulting in a cancellation, Pro features and services included with your plan will cease. Upon downgrade to Lite, if you have more than one (1) active folio, we will automatically archive these folios to bring the account into compliance with our Lite plan restriction of one (1) active folio.

Disclaimer of Warranties; Limitation of Liability

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY BUYFOLIO ON AN "AS IS" AND "AS AVAILABLE" BASIS. BUYFOLIO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE. Applicable Law; Disputes

By visiting the Site, you agree that the laws of the State of New York, without regard to the principles of conflict of laws, will govern the terms of this Agreement and any dispute that may arise between you and Buyfolio. Any such dispute may be heard only in the federal and state courts in the Borough of Manhattan, City of New York, State of New York, and you hereby submit to the exclusive jurisdiction and venue of such courts.

Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Buyfolio without restriction.
